Terms of Service

1. Acceptance of Terms

By creating an account or using DharmaChart ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to create an account or use the App. By using DharmaChart, you represent that you meet this age requirement.

3. Entertainment and Self-Reflection Only

DharmaChart provides astrological interpretations, tarot and oracle card readings, AI-generated companion responses, and related content strictly for entertainment and self-reflection purposes.

You should not make important life decisions based solely on content generated by the App. Always consult qualified professionals for medical, legal, financial, or mental health matters.

4. AI-Generated Content

The App uses artificial intelligence (including Anthropic's Claude and OpenAI's models) to generate interpretations, readings, and companion responses. AI-generated content may be inaccurate, incomplete, or inappropriate. You acknowledge that:

• AI responses are generated, not authored by human experts
• Content quality varies and should not be relied upon as authoritative
• The App includes crisis safety features but is not a crisis intervention service
• If you are experiencing a mental health crisis, contact the 988 Suicide & Crisis Lifeline (call or text 988) or the Crisis Text Line (text HOME to 741741)

5. Your Account

You are responsible for maintaining the security of your account credentials. You may not share your account or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content

You retain ownership of content you create in DharmaChart, including journal entries, card readings, and companion conversations. By using the App, you grant us a limited license to process this content solely for the purpose of providing the service (e.g., AI analysis, pattern detection, encrypted storage).

You agree not to use the App to create, store, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

7. Privacy

Your privacy is fundamental to DharmaChart. Our Privacy Policy describes how we collect, use, and protect your data. Key commitments: sensitive data is encrypted at rest (Fernet encryption), "delete means delete" (no soft-delete or hidden retention), and we never sell your data.

8. Prohibited Uses

You may not:

• Reverse-engineer, decompile, or extract source code from the App
• Use the App to harass, abuse, or harm others
• Circumvent rate limits, usage restrictions, or security measures
• Use automated systems (bots, scrapers) to access the App
• Impersonate another person or misrepresent your identity
• Use the App for commercial purposes without written permission

9. Intellectual Property

DharmaChart, its design, code, content (excluding user-generated content), branding, and documentation are owned by DharmaChart and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

10. Account Termination

You may delete your account at any time through the App's Settings. Account deletion permanently removes all your data from our servers, including journal entries, readings, companion conversations, and saved locations. This action is irreversible.

We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination unless prohibited by law or safety concerns.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ASTROLOGICAL AND CARD READING CONTENT IS FOR ENTERTAINMENT ONLY AND WE MAKE NO CLAIMS ABOUT ITS ACCURACY OR PREDICTIVE VALUE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DHARMACHART AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution

These Terms are governed by the laws of the State of Oregon, United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Portland, Oregon, except that either party may seek injunctive relief in court for intellectual property violations or security breaches. Class actions and jury trials are waived to the extent permitted by law.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
